This Privacy Policy explains how Blacktop ([Blacktop legal entity name], ABN [ABN]) collects, holds, uses and discloses your personal information, and how you can access, correct or delete it. We handle personal information in line with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).
Who we are
Blacktop is an online platform that lets truck drivers create profiles and lets transport operators post jobs and find drivers across Australia. In this policy, “we”, “us” and “Blacktop” mean [Blacktop legal entity name].
Personal information we collect
Depending on how you use Blacktop, we may collect:
- Account details: your name, email address, password (stored only as a secure hash, never in plain text) and whether you are a driver or an employer.
- Driver profile: phone number, location (suburb and state), licence classes, years of experience, truck configurations, technology and systems experience, skills, work-rights status, self-declared driving-record and drug-and-alcohol-testing willingness, availability, owner-driver status and ABN, insurances held, and a profile photo if you upload one.
- Credentials and tickets: the credentials you record (for example licence endorsements, fatigue management, medicals, mining inductions), including their type, expiry date and an optional reference number. We store the fact that you hold a credential and its expiry, not the underlying certificate or document.
- Employer and company details: company name, description, website, contact phone and email, logo and location.
- Activity: job listings, job applications, saved searches and job-alert preferences you create.
- Facebook login: if you choose to sign in with Facebook, we receive your name and email address from your Facebook account.
- Technical information: standard server logs such as IP address, device and browser information, collected when you use the site.
Sensitive information
Some information you may add, such as a heavy-vehicle or coal-board medical or a police-check status, is “sensitive information” under the Privacy Act. We collect this only where you choose to provide it and it is reasonably necessary for your profile, and we store only the status and expiry you enter, not the certificates themselves. You decide whether to add these items. We never ask for, and you should not provide, criminal-history details or spent convictions, only a current or expiry status.
How we collect your information
We collect most information directly from you when you register and fill in your profile or listing. If you sign in with Facebook, we collect your name and email from Facebook. We collect technical information automatically through standard web-server logs.
Why we collect and use it
- To create and operate your driver profile or company listing.
- To let employers search for drivers and to match drivers with relevant jobs.
- To send the job alerts you choose to set up.
- To keep the platform secure and prevent misuse or fraud.
- To respond to your enquiries and to comply with our legal obligations.
Job alerts and direct marketing
If you save a job search, we use your email address to send you job-alert emails (this is direct marketing). Every alert includes a one-click unsubscribe link, and you can turn job alerts off at any time, at no cost. We do not use your details for any other marketing without your consent.
Importing your CV (optional)
If you choose to import your CV, we use automated software to read it and extract your details for you to review. We do not store the CV file itself, only the details you choose to save. You can always fill in your profile manually instead.
When we share your information
- With employers: your profile is visible to signed-in employers, but your phone number and email are shown to employers only if you switch on contact sharing in your profile, or when you apply to a job and the employer engages with your application. You control this and can turn it off at any time.
- With service providers: with providers who help us run Blacktop (for example hosting, image storage and email delivery), under obligations of confidentiality and only for those purposes.
- With Meta:if you use Facebook login, your interaction is also governed by Meta’s terms.
- Where required by law: if we are required or authorised by law to do so.
We do not sell your personal information.
How we store and protect it
We take reasonable technical and organisational steps to protect your information, including hashing passwords, transmitting data over encrypted connections, and limiting access so that contact details are shown to employers only when you have opted in. We keep personal information only for as long as it is needed and then take reasonable steps to delete or de-identify it. We keep your information while your account is active and for a reasonable period afterwards, then take reasonable steps to delete or de-identify it; you can ask us to delete it sooner. Our hosting and storage are provided by [hosting and storage providers / region], to be confirmed before launch.
Overseas disclosure
Some of our service providers (for example cloud hosting, email or Facebook login) may store or process information outside Australia, including in [countries to confirm]. Where this happens we remain accountable for how that information is handled and take reasonable steps to ensure it is protected consistently with the APPs. We will list the relevant countries here before launch.
Accessing, correcting and deleting your information
You can view and edit most details in your profile. You can delete your account and associated data at any time from our data deletion page, or by emailing [privacy@blacktop.au]. If you signed in with Facebook, you can request deletion of the data we received from Facebook the same way. We will confirm when this is done.
Cookies
We use a small number of cookies that are necessary to run the site, including a session cookie that keeps you signed in. We do not use them to build advertising profiles.
Data breaches
If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.
Automated decisions
We do not make automated decisions that produce legal or similarly significant effects about you. Search and matching simply help employers and drivers find each other.
Complaints
If you have a privacy concern, contact us at [privacy@blacktop.au] and we will work to resolve it. If you are not satisfied, you can contact the OAIC at oaic.gov.au.
Changes to this policy
We may update this policy from time to time. The current version is always available here, with the date it was last updated shown at the top.
